Important
This page is a draft that has been through Zappmit’s internal compliance review. It is not yet in effect. It has not been approved by any government body or regulator, and it has not yet been signed off by external legal counsel. Online ordering, payment and delivery are currently disabled on this website.
Scope
These Rider Terms apply to any individual who registers to provide pickup, delivery or related services through the Zappmit platform ("rider", "you"). Read them with the general Terms and your rider agreement or onboarding documents.
Your relationship with Zappmit
Your relationship with Zappmit is contractual. It is governed by the rider agreement or onboarding terms that you accept, and by these Rider Terms. Under that agreement you provide pickup and delivery services using the platform and take on the responsibilities the agreement and these terms assign to you. Zappmit does not promise employment, wages, benefits or insurance beyond what your signed agreement states and the law requires. A contractual description does not decide how the law classifies the relationship, and it does not limit any right or protection that labour, social-security or other law gives you.
Pending legal review
Management has decided that the relationship is contractual. Counsel has not yet reviewed how the law classifies it, or what central and West Bengal labour and social-security duties apply to Zappmit as an aggregator. The signed rider agreement has also not yet been compared with this page. This page therefore promises no employment, benefit, insurance or social-security contribution, and describes no independent-contractor status.
Rider onboarding
You must be at least 18 years old. Onboarding requires the identity, eligibility and vehicle information requested during registration. Zappmit may accept, reject or ask for more information before activating an account.
Identity / KYC requirements
Give accurate identity verification information and update it if it changes. Zappmit may verify it before or after onboarding. Your identity documents are handled under the Privacy Policy.
Vehicle / document requirements
If you use a motor vehicle, you must hold and keep valid the driving licence, vehicle registration, insurance and any permit that the Motor Vehicles Act, 1988 and the rules under it require for that vehicle and use, and you must show them when asked. Zappmit does not provide vehicle insurance unless your agreement says so.
Account security
You are responsible for the security of your rider account and for activity under it. Do not let anyone else use your account.
Order acceptance
You may accept or decline orders offered to you through the app. Repeated non-fulfilment of orders you have accepted, without good reason, may affect your account standing.
Pickup
Collect orders promptly after accepting them and check the order details at pickup as far as is reasonably practicable.
Delivery
Deliver to the address given, by safe and lawful means, and follow the customer's and the platform's delivery instructions where reasonably practicable.
Food handling
Keep food in the sealed packaging you received, in a clean delivery bag, away from non-food items and chemicals, and do not open or tamper with it. Do not deliver food you believe has been tampered with or has spoiled, and tell Zappmit instead. Practise personal hygiene while handling orders, and complete any food-hygiene training that Zappmit asks you to complete.
Proof of delivery
Where the app asks for confirmation, such as a delivery code or a photo, complete that step before marking an order delivered. Do not ask a customer for a code before you are at the delivery address.
Customer interaction
Treat customers, merchants and service providers courteously. Do not harass, abuse or discriminate against anyone. Keep customer contact details and addresses confidential and use them only for the delivery.
Cash / COD handling
For cash-on-delivery orders, collect the correct amount, keep it safe and account for it as the app and your agreement provide. Cash you collect for an order belongs to the order, not to you, until it is settled as those documents provide.
Safety
Take care of your own safety and others' while working, including by wearing a helmet and appropriate protective gear. Do not accept an order if you are unwell, tired or if conditions make it unsafe, and tell Zappmit if you cannot complete one for that reason.
Traffic-law compliance
Follow all traffic laws while providing services. Zappmit does not ask or allow unsafe or unlawful riding or driving, and a delivery time shown in the app is never a reason to break the law.
Prohibited conduct
Do not misuse the platform, tamper with orders, discriminate against customers or merchants, or act unlawfully, fraudulently or abusively while providing services.
Fraud
Zappmit may investigate suspected fraud, such as falsely reporting a delivery as complete or an order as unavailable. Where evidence supports it, it may adjust earnings or suspend the account, as these terms and your agreement provide.
Cancellation
You may decline or, where necessary, cancel an accepted order through the app. Repeated cancellations without reasonable cause may affect your account standing.
Earnings
Earnings, incentives and settlement terms are set out in your rider agreement, onboarding documentation or the app, and are not guaranteed. Zappmit does not promise a fixed income.
Settlement and deductions
Amounts owed to you for completed services are paid to your registered account on the schedule given in your agreement or the app. Zappmit may deduct from what it owes you only an amount that your agreement or the app states. Keep your bank details accurate. Any tax that the law requires Zappmit to deduct from your payments is deducted as the law requires.
Insurance and benefits
This page does not promise accident, health or life cover, or any benefit. Any cover or benefit that Zappmit arranges for riders is described in your agreement or the app, and nothing in these terms reduces a benefit or contribution that the law requires to be provided to you.
The Code on Social Security, 2020 is now in force and treats an online marketplace such as Zappmit as an "aggregator" and a person who works through it as a possible "platform worker". The rules made under it require aggregators to share details of such workers with the Government's designated portal (e-Shram) and to report when they stop working. By registering as a rider you agree that Zappmit may share the details the rules require for that purpose.
Equipment / property
Equipment that Zappmit or a merchant gives you, such as a delivery bag, remains theirs. Look after it and return it as agreed if your participation ends.
Data / privacy
Your information, including your location while you are active on the platform and the photos you capture as proof of delivery, is handled under the Privacy Policy.
Account suspension
Zappmit may suspend your account for breach of these terms, suspected fraud, safety concerns or legal requirements, with notice where practicable. You can ask support to review a suspension you think was a mistake.
Termination
Either side may end the relationship as these terms and your agreement allow. Ending it does not affect amounts already earned or duties that continue by law.
Complaints and appeals
Raise a complaint about an order, a customer, a deduction, a suspension or the platform through the app's support or the Grievance Redressal process. Nothing here limits any right you have to go to a court or other authority.
Incident reporting
Report safety incidents, accidents and disputes that happen while you provide services as soon as you safely can, so that Zappmit can respond.
